Man Passes Out In Locked Car With Kid Inside

A couple who spent the day drinking ended their Saturday behind bars following a child locked in the car with a drunk man passed out, according to the Sarasota County Sheriff's Office.

The sheriff's office says that William Lemacks, 35, of 653 Lake Pansy Drive in Winter Haven and Quinn Gallo, 33, of 1185 Gantt Ave., Sarasota, spent the day drinking and their actions led to putting Gallo's 2-year-old daughter and 10-year-old son into the custody of the 2-year-old's father, who is also the 10-year-old's step father.

Deputies were called to 108 Beach Road at 5:20 p.m., Saturday, by someone who saw a man passed out in a parked running vehicle with a small child in a car seat.

Lemacks told deputies he did not know how the girl got into the vehicle or where the girl’s mother was, deputies said. Lemacks also told deputies he takes Vicodin for a previous injury, according to the report.

Lemacks had bloodshot, watery eyes and had slurred speech and acted surprised the kid was in the car, according to the probable cause affidavit. He failed a field sobriety test and refused to take a breath test, according to the report.

The child was sweating and crying but medical personnel said she was unharmed, deputies said.

Deputies then traveled to the girl's home, and found a 10-year-old boy home alone, according the the sheriff's office. The boy said his mother and sister left at about 10:30 a.m., with a man he didn’t know, the sheriff's office said.

Detectives located Gallo near Beach Access 5 at 6:20 p.m., where she told deputies she was looking for her car. A deputy who was separately investigating a theft at determined Gallo and four other adults left the restaurant without paying a bill more than $200, including 23 alcoholic drinks, according to the sheriff's office.

A manager told the sheriff's office that the restaurant refused to serve LeMacks any more alcoholic drinks "due to his intoxication level," according to the report. 

The Department of Children and Families responded and placed the children with the father of the 2-year-old. Quinn is charged with Child Neglect and LeMacks is charged with Driving Under the Influence with a passenger under 18 in the vehicle.
